Mandamus petition by Vieira seeks CPI to investigate ties of.

The mandamus petition filed by Senator Alessandro Vieira (MDB-SE) this Thursday (17) has once again brought to light the investigation known as the Master case, which involves businessman Daniel Vorcaro and alleged links with justices of the Supreme Federal Court.

What Vieira's mandamus petition demands

Vieira is requesting that the STF establish a Parliamentary Commission of Inquiry (CPI) to investigate the relationship of Alexandre de Moraes, Dias Toffoli, and other magistrates with Vorcaro. The request has 41 signatures and also questions the delay by the President of the Senate, Davi Alcolumbre, in forwarding the request.

Elements underlying the request

The senator points out, among other evidence, a report by Justice André Mendonça containing 52 messages exchanged between Vorcaro and Moraes, in which the businessman seeks advice on an investigation that could lead to his arrest. The report also records Vorcaro asking Moraes: "do you think I should be out by Monday?".

Contracts and payments revealed by the Federal Police

Federal Police investigations showed that the law firm of Moraes's wife, Viviane Barci, signed a R$ 131 million contract with Master, receiving R$ 80 million before being terminated following the bank's liquidation. A second agreement worth R$ 50 million was signed with Viking Participações, a company owned by Vorcaro that was convicted by the CVM for fraud in the issuance of real estate fund shares.

Regarding Toffoli, the PF released records of calls, messages, and transactions, including the payment of R$ 35 million by Vorcaro for a stake in the Tayayá resort, of which the justice admitted to being a partner.

Other links pointed out in the investigations

Data extracted from Vorcaro's cell phone revealed a R$ 427 million contract between Master and a law firm whose partner, Camilla Ramos, has ties to Justice Kassio Nunes Marques, identified as part of "KN's crew".

In addition, the PF identified attempts to influence votes of the STF's Second Panel in cases involving court-ordered debts (precatórios) from the sugar and ethanol sector, highlighting the actions of Gilmar Mendes, who ultimately voted against Vorcaro's interests.

Progress of the request in the Supreme Court

To date, the mandamus petition has not yet been distributed to a rapporteur, unlike 14 other lawsuits that have already been randomly assigned. The group of senators following the case – Vieira, Damares Alves, Eduardo Girão, Magno Malta, and Marcos Pontes – asked Justice Kassio Nunes Marques to step down as rapporteur of the action demanding the installation of the CPI, to ensure consistency in the criteria adopted.

The lawmakers argue that although the CPI request and the judgment on Moraes's report are distinct proceedings, both are offshoots of the Banco Master case and, therefore, require the same level of judicial caution.
