New resolution unifies vehicle purchase and sale stages into an electronic workflow via smartphone

The publication of a new resolution by the National Traffic Council in the Federal Official Gazette regulates the transfer of vehicle ownership in an entirely digital manner. The measure establishes rules to integrate stages such as signing, payment of debts, and completion of the ownership change into a single workflow linked to the National Registry of Motor Vehicles.
How the digital transfer will work
The National Traffic Secretariat is working on implementing the tool that will allow the transfer of used vehicles between individuals through the CNH do Brasil app. The resolution creates three transfer of ownership modalities: conventional, electronic, and custodied electronic.
The transaction modalities
In the electronic modality, buyer and seller will be able to perform, in the same workflow, the registration of the negotiation, the electronic signature of the transfer, the consultation and payment of debts and fees of the State Traffic Departments, as well as the completion of the ownership change. Inspection remains mandatory and will be integrated into the process, with the verification of the chassis, engine, and vehicle characteristics by an accredited professional.
The custodied electronic modality
In the custodied modality, all stages of the negotiation are integrated, including the settlement of taxes, charges, and fines. The negotiation amount remains in custody during the operation, and the money is only released after the transfer is completed. If the operation is not finalized, the rule provides mechanisms to block, reverse, or refund the amount.
Security requirements and platforms
The platforms involved must comply with individual and multi-factor authentication requirements, traceability, auditing, and fraud prevention. Companies will need approval from the National Traffic Secretariat, specific certification, the capacity to restore the service within a set time, and civil liability insurance.
Deadlines and document issuance
The resolution determines that the Vehicle Registration Certificate must be issued exclusively in digital format. Paper documents already issued remain valid until replacement, cancellation, or dematerialization. The rule is already in effect, but the agencies involved and the State Traffic Departments have a deadline to adapt, and the transfer via the app will still be implemented with no announced start date.
