Driver who killed street sweeper in São Paulo will be prosecuted for homicide

On August 4, 2026, the São Paulo Public Prosecutor's Office (MPSP) filed a complaint against the driver who ran over and killed street sweeper Diego Rafael da Silva, 19, on the night of July 26, in the Barra Funda neighborhood, western zone of the capital.

Public Prosecutor's indictment

Prosecutor Mônica Nogueira Rodrigues, responsible for the accusation, sent the indictment to the judiciary on Friday (31) and charged the defendant with doubly qualified homicide, based on articles 305 and 306 of the Brazilian Traffic Code.

Driver's conduct

The breathalyzer test showed a concentration of 0.73 milligrams of alcohol per liter of exhaled air, indicating that the driver was operating under the influence of alcohol and at a speed incompatible with the road, in addition to having fled the scene after the collision.

Prosecutor's requests

In addition to the initiation of criminal proceedings, the MPSP requested the continuation of preventive detention, the suspension of the driver's license if convicted of driving under the influence, and the setting of a minimum compensation of R$ 500,000 in favor of the victim's relatives.

Circumstances of the accident

According to the prosecutor, the driver slammed the vehicle into a section of the road where the entire Loga waste collection crew was working, also hitting other vehicles and motorcycles traveling in the area. The victim was caught off guard while performing his duties, unable to perceive the risk or react.

Next judicial steps

With the indictment accepted, the case will proceed to trial, where the presented evidence will be evaluated and the possible application of the penalties provided for qualified homicide and for driving under the influence of alcohol.
