Mayanna Angelina Rodgers, 29, was released from the Guaíba Women's State Penitentiary on Friday morning following a decision by the 1st Criminal Court of the Jury and Criminal Enforcement of Viamão that replaced preventive detention with alternative precautionary measures.

judicial decision and precautionary measures

The Rio Grande do Sul Judiciary granted provisional release to the mother of 3-year-old Oliver Grayson, who died in July. The measure replaces preventive detention with an electronic ankle monitor, nightly house arrest, and a prohibition on contact with her children. Mayanna remains at the disposal of the Court to cooperate with the investigation.

Mayanna's criminal liability

Mayanna faces four counts of torture by omission related to Oliver and his three siblings. The homicide charges were dismissed, as the judge considered that there were no longer grounds for preventive detention. The father, American missionary D’andre Grayson, remains in preventive detention for aggravated homicide and four counts of torture.

context of the assaults

The police investigation indicated that Oliver was beaten by his father on July 5 for not saying "good morning." The autopsy identified severe blunt head trauma as the cause of death. The physical forensic examination identified old scars on the child's body, which were not related to the assault that caused his death.

investigations into the family

The Civil Police gathered evidence indicating that the abuse against the children had been occurring repeatedly for about nine years. The mother had allegedly instructed the children not to show their bodies and not to tell others about the abuse. All the children, with the exception of the 1-year-old baby, had marks on their bodies, and only one was able to speak with the forensic expert.

outlook for the children

Mayanna's children are being housed in a shelter, and according to the defense, the eldest son, aged 9, expressed a desire to see his mother. Resuming contact depends on future judicial decisions. The defense is seeking alternatives so that Mayanna can have contact with her children within legal parameters.

conclusion of the case

The decision by the 1st Criminal Court of Viamão acknowledges the lack of Mayanna's involvement in Oliver's homicide, as the charge was dismissed. The proceedings for torture by omission remain underway, and the mother remains under precautionary measures that limit her contact with the children.
