TSE suspends Deltan Dallagnol's Senate campaign

Deltan Dallagnol, a candidate for the Senate representing Paraná for the Novo party, has had his campaign suspended by the Superior Electoral Court (TSE). The decision, issued by Minister Floriano de Azevedo Marques, prevents the use of public funds and electoral advertising, following a request from the Paraná Para Todos coalition and the Brasil da Esperança Federation.

Suspension of Deltan Dallagnol's Campaign

Minister Floriano Azevedo Marques, on an urgent basis, prohibited Dallagnol from receiving or using funds from the Party Fund (Fundo Partidário) and the Special Electoral Campaign Financing Fund (FEFC). The transmission of free electoral advertising on radio and television was also forbidden, as was the practice of other campaign acts, including participation in debates.

Grounds for the TSE's Decision

Marques based the measure on the understanding that Dallagnol's resignation from the Public Prosecutor's Office, made 11 months before the 2022 elections, constituted fraud against the Clean Slate Law (Lei da Ficha Limpa). According to the minister, the resignation aimed to prevent 15 administrative proceedings underway at the National Council of the Public Prosecutor's Office (CNMP) from turning into Disciplinary Administrative Proceedings (PADs), which could lead to dismissal or compulsory retirement.

Appeal by the Paraná Para Todos Coalition

The Paraná Para Todos coalition and the Brasil da Esperança Federation filed an appeal with the TSE against the decision of the Regional Electoral Court of Paraná (TRE-PR), which had allowed Dallagnol's candidacy registration. The request aimed to suspend the transfer of public funds and electoral advertising, as well as to prevent the carrying out of campaign acts.

Consequences for Funding and Advertising

With the injunction, Dallagnol will not be able to access funds from the Party Fund or the FEFC already received. He will also be prevented from promoting his candidacy in media outlets that receive public funds, which significantly limits his ability to reach voters.

TSE's Stance on the Resignation

The minister highlighted that, at the time of the resignation, the 15 administrative proceedings against Dallagnol were ongoing, with no indication of an acquittal decision. The subsequent archiving of these processes occurred because Dallagnol ceased to be a member of the Public Prosecutor's Office, and not due to a favorable decision for the candidate. This circumstance, according to the minister, would have rendered Dallagnol ineligible.
