Supreme Court in crisis: STF to rule on case involving Moraes

Last Thursday, the President of the Federal Supreme Court (STF), Edson Fachin, sent the offices of the justices the full text of a case containing a Federal Police report and messages attributed to banker Daniel Vorcaro, which reference Justice Alexandre de Moraes. The move intensifies the internal crisis that has marked the Court in recent weeks and prepares the plenary for the extraordinary session next Tuesday, September 15.

Delivery of the full case file

Fachin made the complete material available for the justices and their teams to analyze prior to the trial. The case includes the Federal Police report, which had its confidentiality lifted by a decision from Justice André Mendonça, and Vorcaro's messages pointing to Justice Moraes.

Lifting of confidentiality and request for investigation

Two days prior to the delivery, Mendonça lifted the confidentiality of a Federal Police report revealing conversations between Moraes and Vorcaro. In response, Moraes requested the PF to send documents mentioning members of the Court, alleging a risk to the independence of the magistrates.

Suspension of internal procedures

Fachin also ordered the suspension, until a plenary decision, of procedures involving members of the Supreme Court. This measure is part of a set of actions to reorganize the handling of processes related to the institutional crisis.

Position of the STF President

At an event at the Planalto Palace, Fachin stated that the Court's response will be "firm and rigorous," but without "hastiness." He emphasized that the gravity of the facts does not authorize shortcuts and that no authority is above the Constitution.

Next steps before the trial

Fachin opened a deadline for Moraes and Mendonça to make statements. Clarifications must also be provided by Prosecutor General of the Republic, Paulo Gonet, and Federal Police Director-General, Andrei Rodrigues, both mentioned in Vorcaro's messages. The extraordinary session, scheduled for the morning of 09/15, will be the first moment the STF plenary analyzes the case in its entirety.
