The Federal Supreme Court (STF) ruled this Thursday (24) that Brazilian states cannot unilaterally revoke tax benefits for the State Value Added Tax (ICMS) that were approved through agreements of the National Council of Fiscal Policy (Confaz).

Under this ruling, the precedent established by the STF prevents any state from unilaterally canceling advantages granted through these agreements, reinforcing the requirement to comply with nationally established rules for modifying tax benefits.

The measure highlights the importance of consensus among federated entities when dealing with tax benefits, ensuring that unilateral changes do not compromise the uniformity of the national tax policy.
