Flamengo and Paolo Guerrero have reached an agreement that ends two lawsuits spanning nearly eight years. The club and the former striker finalized a confidential settlement, keeping the amounts involved secret.

how the case unfolded

Since the striker's departure in August 2018, the club had filed two lawsuits against the Peruvian player. In one, Flamengo sought to recover more than R$ 1.8 million paid to Guerrero during his doping suspension. In the other, the club claimed R$ 200,000 in moral damages, also involving the Peruvian Football Federation.

the R$ 1.8 million lawsuit

  • Flamengo claimed that the 121-day suspension hindered the commercial exploitation of the player's image
  • the court upheld the ruling and denied the club's appeal, highlighting that the sports suspension did not automatically interrupt the image rights contract
  • the case reached the Superior Court of Justice, but the special appeal was not admitted and the club filed an interlocutory appeal

the R$ 200,000 lawsuit

  • Flamengo sought to recover the amount for moral damages, but faced difficulties in serving the defendants in Peru and abroad, requiring letters rogatory and judicial requests
  • the lawsuit had not yet reached a verdict regarding the claim, remaining focused on the regularization of the service of process

the agreement that ended the fight

Last Monday, the club and the player informed the Court of Rio de Janeiro that they had reached a confidential agreement to end the lawsuits. The settlement amount remains secret, but the motion for dismissal was signed by Flamengo's attorneys, Michel Asseff Filho and André Oliveira de Meira Ribeiro.

impacts for the club and the athlete

The conclusion of the lawsuits puts an end to the dispute that had dragged on for nearly eight years. For Flamengo, the decision avoids further court instances and potential legal costs. For Paolo Guerrero, the agreement resolves the financial issue related to the doping suspension, allowing him to focus on his career without the shadow of pending lawsuits.
