Fachin Assumes Rapporteurship in Vorcaro and Moraes Case
STF President decides to separate cases and halts investigations
Last Friday, Edson Fachin, president of the Supreme Federal Court, assumed the rapporteurship of the case involving Minister Alexandre de Moraes and former banker Daniel Vorcaro. The measure was taken before the extraordinary session scheduled for Tuesday, when the ministers are expected to analyze the Federal Police's report on the messages exchanged between the two.
Case Separation and Investigation Halt
Fachin determined that the matter be analyzed separately from the questions regarding the actions of André Mendonça, another rapporteur involved in the Master case. The decision also refers to the Court's Presidency the proceedings related to investigations into fraud at the National Social Security Institute (INSS) and Banco Master, keeping them halted until a new decision.
Contents of the Released Documents
The second batch of materials, released by Mendonça on Friday, covers 53 procedures. Among them are information about Dark Horse's production, Vorcaro's businesses, and his relationship with politicians. The Federal Police report indicates that the production company Go Up Entertainment paid credit card bills for federal deputy Mario Frias, who acts as a screenwriter and executive producer for the feature film. Payments ranged from R$ 32.6 thousand to R$ 36.8 thousand between August and November 2025.
Prosecutor General's Office Reaction
The PGR argued that Mendonça should not have requested an investigation into the recipient of the former banker's messages without a request from the Public Prosecutor's Office or the Federal Police itself. It also maintains that the competence to decide on the eventual investigation involving Moraes belongs to the STF plenary, and that Mendonça's order to track Vorcaro's interlocutors would be null and void, violating the accusatory system.
Next Steps in Tuesday's Session
In the extraordinary session, the ministers will discuss the validity of the Federal Police report. The rapporteur, now Fachin, will present a summary of the main facts under analysis and will cast the first vote, potentially guiding the decision on whether to open or shelve the investigation against Moraes. If the ministers agree with the PGR, the evidence obtained from Mendonça's order may be considered invalid and removed from the investigation.
Impact of Decisions on Data Custody
Fachin also gave the Federal Police 24 hours to inform about the custody conditions and the state of the material extracted from Daniel Vorcaro's cell phones. The response could influence the ministers' analysis of the material. Meanwhile, the session will be broadcast by TV Justiça, but access to the plenary will remain restricted.
